What does a 6th category seller need to know? Retraining of sellers

How to apply the qualification requirements for a 6th category salesperson when hiring: “For assignment of the 6th category in the profession “Salesman”, secondary specialized (vocational) education is required without presenting requirements for work experience” for the following employees:

− employee “A”. Has secondary specialized education, qualification “merchandise expert”. Is it possible to accept it as a 6th tier seller?

It is impossible to immediately accept either employee “A” or employee “B” as a 6th category seller.

An employment contract is an agreement between an employee and an employer, according to which the employee undertakes to perform work in one or more specific professions, specialties or positions of appropriate qualifications in accordance with the staffing table (Article 1 of the Labor Code of the Republic of Belarus (hereinafter referred to as the Labor Code)).

Taking into account the said norm of the Labor Code, an employment agreement (contract) with an employee in the profession “Seller” is concluded indicating his qualifications.

For information . Qualification is understood as the level of general and special training of an employee, confirmed by the types of documents established by law (certificate, diploma, certificate, etc.) (Article 1 of the Labor Code).

The qualification requirements for the 6th category sales profession (issue 51 of the Unified Tariff and Qualification Directory of Work and Professions of Workers (UTKS), approved by Resolution of the Ministry of Labor and Social Protection of the Republic of Belarus dated November 25, 2003 No. 146) establishes that for the assignment of the 6th category in the profession “Seller” requires secondary specialized (vocational) education without any requirements for work experience or work experience of at least 3 years in the profession “Salesman” of the 5th category.

An employee’s qualifications can only be indicated if they were assigned to the employee in the manner prescribed by law. Qualification requirements are necessary to assign a qualification to an employee in accordance with the General Provisions of the ETKS, approved by Resolution of the Ministry of Labor and Social Protection of the Republic of Belarus dated March 30, 2004 No. 34.

Since employees “A” and “B” do not have a qualification assigned in the established manner (6th category) in the profession “Seller”, secondary specialized education in the specialty “Commodity Expert” (employee “A”) and the specialty “Accounting and Auditing” "(employee "B") is not a sufficient condition for confirmation of qualifications.

In order to comply with labor legislation, when hiring unqualified workers, the provisions of the Regulation on guarantees for employees sent by the employer for vocational training, retraining, advanced training and internship, approved by Resolution of the Council of Ministers of the Republic of Belarus dated January 24, 2008 No. 101, are applied. In accordance with this document, with an employee who does not have the necessary qualifications, the employer enters into an employment agreement (contract) in the relevant profession without specifying the rank and, simultaneously with hiring, sends the employee for training (advanced training) to obtain the rank required by the organization, in the manner and on conditions determined by the collective agreement.
