The results of the annual professional skills competition “Best in the Profession” were summed up in the regional court. Based on the results of the competition, Tatyana Katsapova, representing the regional court, was recognized as the best assistant judge. A Lipetskaya Gazeta correspondent met with the winner and asked her several questions.

- Tatyana, how did you get into the profession? How long have you been working as an assistant judge?


The question of choosing a profession was not difficult for me. While studying school science in high school, I already knew for sure that I would definitely become a lawyer. Jurisprudence seemed to me the most interesting and most necessary area of ​​knowledge. I was not mistaken in choosing a profession and still believe that it is the best. After school, she first studied at the Lipetsk Cooperative Technical School, and then entered the Lipetsk branch of the Voronezh Economic and Legal Institute. As a third-year student, I became a court secretary, then worked as a court secretary in the Right Bank Court of Lipetsk, and since 2012 I have held the position of assistant judge. My total legal experience is 14 years.


- Please tell us about the competition, what it consisted of, what experience did you gain by participating in it?


The “Best in Profession” competition was held in two stages. First, each court selected candidates to participate in the competition. In the second stage, the contestants were asked to answer questions from the theoretical part of the test and complete a practical task. To successfully write papers, it was necessary to demonstrate knowledge of legislative acts, as well as be attentive to spelling and the correct execution of documents. The experience gained in participating in the competition played a significant role in improving professional skills, the desire to realize and achieve the set goals.


- What is your job and what qualities help you in it?


I take part in the consideration of civil, administrative cases and cases of administrative offenses. My responsibilities as an assistant judge include drafting court decisions, excluding personal data of participants in the process from the texts of judicial acts published on the official website of the court on the Internet, and carrying out other assignments of the judge and the chairman of the court. The most interesting thing for me is drafting judicial acts; this part of the work is also the most labor-intensive. It is also necessary to respond to the arguments of appeals and cassation complaints. What helps me successfully cope with my responsibilities is diligence, a conscientious attitude to work, and the ability to perform several tasks at the same time. I learned a lot during the process.


- What are your plans for the future?


I would really like to become a judge, I am especially interested in civil and administrative cases. In the near future, I plan to pass the qualification exam to participate in the competition for the position of judge. Sufficient work experience, as well as additional knowledge acquired during preparation for the competition, allows me to become a contender for this title. The qualifying exam involves three theoretical questions, two tasks, and the preparation of a procedural document. Successful passing of the exam gives a chance to obtain professional judicial status.

Work is part of our life. And it should be pleasant and loved, like a hobby. This concept very closely fits the concept of an ideal job, since a hobby is a type of human activity, a kind of activity, a hobby that is regularly practiced at leisure, for the soul. Hobbies are a good way to combat stress, and hobbies often help develop your horizons. The main goal of a hobby is to help self-realization. Often, over time, a hobby develops into a main activity, a job that brings income and moral satisfaction. Therefore, an ideal job is an activity that you enjoy and, in addition, generates income. Usually, a person chooses as his main job exactly what he liked, as a hobby or main hobby “for the Soul.”

An ideal job is a person’s purpose and self-realization. After all, we put our soul into our work, realize our abilities, satisfy our needs, fulfill our desires. An ideal job should correspond to the rhythm of life and fit exactly into a person’s personal characteristics. It gives a person the opportunity to be in his place and do his job.

I believe that the choice I made in a professional direction gave me an incentive to engage in an ideal job that gives the right to self-realization and satisfaction of life ambitions, such as:

  • engaging in an activity that is reliable and stable, brings pleasure from both the process and the result, which is interesting and even creative, preserves personality, promotes development: spiritual, personal and professional growth of myself and my employees;
  • implementing reasonable communication with people, social benefit, promoting good relations with employees;
  • obtaining income that allows you to support your family and help your parents make savings;
  • availability of time for family, rest, self-development.

So, my hobby is being a lawyer.

The legal profession is one of the oldest. It originated in Ancient Rome. The first professional lawyers were members of the College of Pontiffs, who were involved in resolving almost all controversial issues that arose among citizens. They also helped people in concluding important transactions, drafting claims and other important legal documentation. The very concept of the term “lawyer” comes from the Latin word meaning “law”, and therefore jurisprudence means “knowledge of the law”. The founders of law as a branch of science were such philosophers of the ancient world as: Socrates, Aristotle, Plato.

Currently, the essence of the profession has not changed somewhat and lawyers, like their ancient colleagues, the pontiffs, perform the same functions, widely using in their work the experience accumulated over centuries.

Modern lawyers provide a wide range of services. They help citizens in resolving various cases. Also, they officially represent the interests of persons in court and appeal court decisions to various authorities.

In addition to providing services to individuals, lawyers also participate in the activities of enterprises. They effectively accompany enforcement proceedings and provide advice on legal issues related to taxation and business. Lawyers are entrusted with registration and support of societies, institutions, and organizations. They are also involved in the registration (liquidation) of all limited liability companies and individual entrepreneurs. Participate in the development of all kinds of contracts, constituent documents, instructions, and other legal documents.

The positive aspect of this profession is the opportunity to improve the world for the better, make it safe and fair. Unfortunately, the “struggle for justice” does not always end in victory. In addition, every lawyer is constantly under the close control of higher authorities, public organizations and media workers, and each of his mistakes can greatly affect his reputation and jeopardize his career in the future.

Now the concept of “lawyer” unites all people engaged in diverse professional legal activities - judges, investigators, prosecutors, notaries, legal advisers, lawyers, and sometimes experts. In the Russian Federation, a lawyer can be a person who has received secondary or higher professional legal education. As a general rule, in order to defend persons brought to criminal liability, a lawyer must pass a qualification exam and become a lawyer; at the request of the accused, as well as in cases of private prosecution, it is possible to admit another person to carry out the defense. To provide legal assistance in civil, administrative and other cases, a lawyer does not need to have the status of an attorney.

So, who is a “lawyer”? A lawyer is a specialist who has professional knowledge in the field of legal sciences, laws and knows how to apply them in his practical activities. Provides services to protect the rights and interests of individuals and legal entities, and also carries out consulting activities on legal issues related to doing business and drawing up legal documentation .

I started practicing as a lawyer not so long ago, since I have little experience and an incomplete higher legal education. However, my work has become the meaning of life - my hobby. A job that brings joy from communicating with people from different walks of life and fields of activity, positive emotions, prosperity and popularity, and also develops in such popular industries as forensics is a dream job, you must agree... That’s why I chose to work as a lawyer.

Why did I choose the specialty of an expert?

My name is Maria, I am a 3rd year student at the Faculty of Law of Moscow State University. M.V. Lomonosov, Department of Criminalistics. Every student in the 3rd or 4th year asks himself the question whether he is making the right choice of specialty, and often this question does not depend on whether you have dreamed of this specialty all your life or are trying to decide while receiving your education. My dream has always been to become a criminologist. It all started with unconscious and abstract images in childhood, obtained from books and documentaries, of which there were a countless number in my leisure time already in elementary school. I continued studying the profession at a distance in high school and, finally, entering the main university of the country. And now, when half of the training has been completed, I wonder if I deceived myself by blindly following my childhood dream. The answer to this question will be the subject of my short essay, which I hope will not be too boring and trivial for the reader.

Why did I choose this specialty? Because I am 99.9% sure (even if we put aside the maximalism typical of young people) that this is my element. Attentiveness, responsibility, education and development - not only these qualities should characterize an expert. Rigor and agility of intellect and quick wit also need to be mentioned in this list. These qualities are either inherent to the individual by nature or develop with experience, and it cannot be said that specialists in other industries may not possess them. Therefore, I will highlight, in my opinion, the most important thing - a person should “be passionate” about his profession in the good sense of the word. I chose this specialty because I am “sick” of it not emotionally, but mentally. For me, this is limitless scope for science - searching for new problems and studying old ones. For me, this is the living key of creativity - finding solutions and innovating methods. For me, this is an opportunity to direct all the sharpness of my mind to an object and fish out the smallest details, go from the particular to the general, and assemble one big puzzle. What is important to me is a constantly growing interest, the opportunity to learn, cultivate a large amount of material within myself and pour it into practice.

I have a lot to say about my choice. The key is the dynamics and scientific nature of the profession. There are many strong walls built around these categories that make my decision strong and unshakable. And now, to answer my own question: I was not mistaken.

My speciality

As Confucius said: “Choose a job you love, and you will never have to work a day in your life.”

While still at school, I learned about the specialty “Customs Affairs”; I was immediately very interested in it, since one of its specializations is “Commodity research and examination in customs affairs and Commodity Nomenclature of Foreign Economic Activity”. When entering the university, I had absolutely no doubts about my choice, considering this area of ​​scientific knowledge not only one of the most interesting, but also useful.

Having completed an internship at the Tula Forensic Laboratory, I was not at all disappointed in my choice. Every day of practice I was in different departments: from handwriting to auto technical; I constantly learned something new for myself. Helping experts carry out their research, working with all kinds of reagents and using special equipment, I realized how interesting and exciting this profession is!

Years of study at the university and the wealth of knowledge, skills and abilities instilled in us by our teachers, including practical forensic workers, allow me to look forward with hope and optimism to the start of my career in the field of forensic science. Of course, I still have a lot to learn, but thanks to the experience of our teachers and the guidance of practical workers, I am sure that the profession I have chosen for study is very important and relevant, and the knowledge gained from this will be useful to me in all areas of my life.

Why I want to become an expert linguist

I don’t know if it’s possible to become a specialist in the field of linguistic expertise without having a legal education?.. It seems to me that it is still necessary. No matter how strong a philologist may be in his field, it is the legal profession that teaches you to work with material the way an expert should work: clearly set tasks, solve them accurately. I think that when working with the material under study, intuition can also play a role, but only at the first stage, then everything must be verified by scientific methods.

My experience in linguistic expertise is so far limited to the analysis of court decisions under Art. 128.1 of the Criminal Code of the Russian Federation and the study of special literature. I also try to determine the emotional state of the authors of the texts, their (the authors’) psychological characteristics. Working with written student work, I became convinced that his handwriting says a lot about a person. Sometimes even too much.

Of course, this is still naive, amateurish (with the exception of the coursework): at times I remind myself of the heroines of Daria Dontsova. But this is interesting to me, and I want to engage in linguistic expertise seriously.

1. General Provisions.

These Regulations establish the procedure and conditions for holding a competition for the title “Best by profession” among state civil servants of the Orenburg regional, Arbitration, district, city, garrison military courts and state civil servants of the Orenburg regionOrenburg region(hereinafter referred to as the Competition).

The competition is a form of improving the professional training of court employees, associated with checking and assessing the level of their training in the performance of assigned official duties.

The competition is held annually. Specific dates for the Competition are established by the Competition Commission at least two months before its start and are communicated to all courts and judicial districts of magistrates Orenburg region.

The main goals of the Competition are:

Stimulating the interest of state civil servants of courts and judicial districts of magistrates areas in continuous improvement of their qualifications;

2. Founders

The founders of the Competition are the Orenburg Regional Court, the Administration of the Judicial Department at the Supreme Court of the Russian Federation in the Orenburg Region (hereinafter referred to as the Administration), the Council of Judges of the Orenburg Region, the Arbitration Court of the Orenburg Region and Committee for ensuring the activities of justices of the peace in the Orenburg region.

3. Competition nominations

The competition is held in the categories Best in Profession:

1. assistant judge (assistant to the chairman of the court, consultant);

2. head of department (chief specialist, leading specialist);

3. secretary of the court session;

4. court secretary.

One nominee is recognized as the winner in each category.in the Orenburg regional, Arbitration, district, garrison military courts of the region and 1 nominee each from all judicial districts of justices of the peace in the region.

4. Participants of the Competition.

Participating in the Competition state civil servants of the Orenburg regional, Arbitration, district, city and garrison (military) courts, judicial districts of magistrates Orenburg region on the proposal of the chairman of the court, the magistrate, who have experience in court, court district of the magistrate at least 3 years, and meeting the criteria in accordance with Appendix No. 1 to these Regulations.

5. Competition commission.

The competition commission is formed by the Council of Judges consisting of:

From judges of the Arbitration Court of the Orenburg Region - 2 people;

At least three representatives of the Council of Judges of the Orenburg Region;

- from the Committee for ensuring the activities of justices of the peace of the Orenburg region - 2 people;

From district (city) courts of the region - 2 people;

From regional magistrates – 1 person.

At a meeting of the Competition Commission, a chairman and secretary are elected, and work regulations are approved.

6. Procedure for holding the Competition.

The competition is held in two stages:

At the 1st stage.

Chairmen of courts and justices of the peace conduct a preliminary selection of competition participants at a general meeting of the labor collective of the court and judicial district according to the criteria specified in Appendix No. 1 and send submissions with the minutes of the meeting of the labor collective to the Competition Commission. Justices of the peace, where several judicial districts in the district can hold a general meeting of employees of the judicial districts of the district.

The number of applicants for participation in the competition from each court is no more than 5.

The competition participants submit: functional responsibilities and competition works, including draft documents, an approximate list of which is indicated in Appendix No. 2.

At the 2nd stage.

The competition commission conducts a preliminary selection of competitors and evaluates the submitted works on a five-point scale. From each nomination, at least 3 and no more than 5 court personnel are selected for participation in the competition. and court districts of magistrates.

If the preliminary selection determines a smaller number of competitors, the competition is considered invalid and is postponed to the next year.

After the preliminary selection, the commission conducts a one-time test of the contestants based on tests approved by the Competition Committee. (Tests include questions on legislation, judicial records management, work regulations, practical drafting of documents, resolution of conflict situations with citizens, etc. Tests are compiled on general issues and taking into account the specifics of each position).

The decision on the preliminary selection of competitors and the winners of the Competition in accordance with the nominations is made by open voting by a majority vote of the present members of the Competition Committee. In case of equality of votes among the members of the commission, the vote of the chairman of the commission is decisive.

The results of the Competition and the decision of the commission are documented in a special protocol.

7. Awards for the winners.

The results of the Court Competition are taken into account when considering issues of assigning regular and extraordinary special ranks, awarding badges of honor, as well as applying other forms of material incentives.

The decision of the commission based on the results of the Competition is the basis for issuing an order of the chairman of the Orenburg Regional Court, the Arbitration Court, the head of the Judicial Department at the Supreme Court of the Russian Federation in the Orenburg Region, Chairman of the Committee for Supporting the Activities of Magistrates of the Orenburg Region on awarding cash prizes to the winners of the Competition and awarding diplomas “Best in the Profession”.

The competition work includes the disclosure of the topic “Knowledge of one’s profession, the goals and objectives of the state civil service and the role of a court employee in the implementation of the concepts of Judicial reform.” You should reflect the main directions of your work, their features and emerging difficulties and proposals for eliminating them, a vision of the prospects of your profession (specialization).

The number of sheets in the competition work should not exceed 5.

Draft documents are attached to the work. An approximate list of draft documents is indicated below for each of the nominations and is required for preparation. Draft documents should be drawn up based on the competitor’s specialization.

Competition work andDraft documents must be drawn up on A4 format paper, font 14. The list of draft documents is approximate and can be increased at the discretion of the competitor. In terms of volume, draft documents should fit on no more than 10 sheets. The volume will not affect the commission’s assessment of professional qualities.

If additional duties were assigned that fall under another nomination (profession) or the duties do not include the preparation of any documents, this should be reflected in the competitive work and a copy of the job duties (Regulations) should be attached.

2. head of department (chief specialist, leading specialist) - samples of work orders, work books, contracts with general workers, time sheets, completed payment documents;

3. court secretary – minutes of court hearings in criminal, civil cases and materials;

4. court secretary: completed USC (cards), samples of journals and orders, execution work (from cases, materials - writs of execution, accompanying).

It is also possible to provide the results of real work - reports, certificates of work, compiled summaries of judicial practice, business letters, responses to citizens' requests, results of work in reception rooms with citizens and other documents not included in the list.

If the nominee has previously participated in other competitions, then the results of work and projects that have not previously participated in competitions must be presented.

2. Procedure for holding the competition

2.1. The competition is announced by a resolution of the Council of Judges of the Republic of Bashkortostan and is held annually in two stages in the following nominations:

― “Best assistant judge (assistant to the chairman of the court, consultant)”;

― “The best court secretary”;

― “The best head of the department (chief specialist, leading specialist, court secretary).”

Participating in the Competition are state civil servants of the Supreme Court of the Republic of Bashkortostan, the Arbitration Court of the Republic of Bashkortostan, district, city and garrison (military) courts, court districts of justices of the peace of the Republic of Bashkortostan on the proposal of the chairman of the court, the justice of the peace, approved by the chairman of the higher district court, having work experience in court, in the court district of a magistrate for at least 3 years, as well as meeting the criteria in accordance with clause 2.4 of the Regulations.

Submissions of competition participants are sent to the Competition Committee.

2.2. The first stage of the competition is held until the first Friday of September of the current year.

2.3. At the first stage, court chairmen, taking into account the opinions of judges and heads of structural divisions, select participants in the competition.

Representatives of courts up to 7 judicial panels:

Assistant judge (assistant to the chairman of the court, consultant);

Head of department (chief specialist, leading specialist, court secretary).

Representatives of courts of more than 7 judicial panels:

Two assistant judges (one from each specialization, panel);

Two court secretaries (one from each specialization);

Two heads of department (chief specialists, leading specialists, court secretary).

Representatives of the judicial districts of magistrates (from 1 to 3 from the judicial district based on the staffing table):

Assistant Judge;

Secretary of the court session;

Secretary of the apparatus.

Chairmen of courts, justices of the peace (in agreement with the chairman of a higher court) conduct a preliminary selection of competition participants at a general meeting of the labor collective of the court and judicial district according to the criteria specified in clause 2.4 of these regulations and send submissions with the minutes of the meeting of the labor collective to the Competition Commission. Justices of the peace, where several judicial districts in the district can hold a general meeting of employees of the judicial districts of the district.

The competition participants submit: functional responsibilities and competition works, including draft documents, an approximate list of which is indicated in Appendix No. 1.

2.4. The selection of participants is carried out according to the following criteria:

Level of professional training:

knowledge of the legislation regulating the state civil service of the Russian Federation, the organization of the judicial system of the Russian Federation;

skills in working with regulatory legal acts, the ability to apply them in practice;

knowledge of court proceedings;

checking compliance with legal requirements when accepting applications and appeals;

skills in working with official information, the ability to analyze and summarize it;

skills of analytical work on summarizing judicial practice, systematization and codification of legislation, selection of normative legal acts, materials of judicial practice necessary for considering a case for assistant judges;

performing actions to prepare cases for trial for court secretaries;

drafting documents, cover letters and business letters for court clerks;

preparation of draft judicial acts, minutes of court hearings, business letters that meet the requirements of logical presentation of the material, legal and stylistic literacy, absence of grammatical errors;

skills in working with subsystems of the State Automated System of the Russian Federation “Justice” (software complex “SAD”), their level;

skills in working with the reference and legal systems “Consultant”, “Garant”.

Compliance with labor discipline, internal labor regulations, and ethical behavior of government civil servants;

Personality characteristics.

2.6. To participate in the second stage of the competition, no later than the first Friday of October of the current year, the following must be submitted to the Council of Judges of the Republic of Bashkortostan (Ufa, Matrosova St., 1):

Participant's application;

Presentation by the chairman of the court;

A copy of the competitor's job description.

2.7. To conduct the second stage of the competition, a competition commission is created consisting of:

1 representative - judge of the Arbitration Court of the Republic of Bashkortostan;

1 representative from the Office of the Judicial Department in the Republic of Bashkortostan;

1 representative from the Office of the Republic of Bashkortostan for organizing the activities of justices of the peace and maintaining registers of legal acts

1 representative from judges of district (city) courts by decision of the Council of Court Chairmen;

1 representative from justices of the peace by decision of the Office of the Republic of Bashkortostan for organizing the activities of justices of the peace and maintaining registers of legal acts;

1 representative - independent expert.

The competition committee selects a chairman and secretary.

2.8. The commission examines the submitted documents specified in clause 2.6. Regulations and evaluate the results of applicants’ performance of a complex task containing the following stages:

2.8.1. Test tasks to assess knowledge of current legislation in accordance with the participant’s specialization (including the provisions of the Federal Law “On the State Civil Service of the Russian Federation”).

To form a database of test questions, a working group consisting of:

1 representative from the Council of Judges of the Republic of Bashkortostan;

1 representative - judge of the Supreme Court of the Republic of Bashkortostan;

1 representative each from employees of the apparatus of the Supreme Court of the Republic of Bashkortostan and employees of the apparatus of the Arbitration Court of the Republic of Bashkortostan;

1 representative of the Arbitration Court of the Republic of Bashkortostan;

2 representatives from teachers of legal disciplines of educational institutions of higher professional education, researchers with an academic degree in a legal specialty.

2.8.2. Practical tasks:

Ability to work in the state automated system “Justice”;

For an assistant judge: preparation of draft judicial acts (sentences, decisions, other procedural documents);

For the secretary of the court session: the ability to draw up a draft protocol of the court session in accordance with the requirements of the Code of Criminal Procedure of the Russian Federation, the Code of Civil Procedure of the Russian Federation, to fully and correctly record the testimony of the participants in the process;

for the head of the department: knowledge of the procedure for conducting office work;

for a court specialist: knowledge of the procedure for filling out registers;

for a specialist, consultant: project for summarizing judicial practice;

2.8.3. The creative task is to prepare a report (speech, self-presentation) about your profession and defend it in front of the commission members.

The topic of creative homework is indicated directly in the Resolution of the Council of Judges in the Republic of Bashkortostan on the announcement of the corresponding competition. (Appendix No. 1)

2.9. The level of complexity of theoretical questions and practical tasks must meet the requirements for the positions of assistant judge, court secretary, court secretary.

3. Summing up the results of the competition and encouraging the winners

3.1. The results of the competition are formalized by the Resolution of the Council of Judges of the Republic based on the decision of the competition commission.

All materials that served as the basis for its adoption are attached to the decision of the competition commission.

3.2. Each competitor is awarded a certificate of participation in the competition in the corresponding nomination.

3.3. The winners of the second stage of the competition - the participants who scored the most points - are awarded diplomas “Best Assistant Judge”, “Best Court Secretary”, “Best Head of Department”, signed by the chairman of the Council of Judges of the Republic.

In the nominations “Best assistant judge”, “Best court secretary”, two winners are determined, respectively, by specialization (colleges).

3.4. In order to actively participate in the competition for court employees, as an incentive for civil servants who took prizes in the competition, the issue of early assignment to their next class rank, as well as a monetary bonus due to savings in the wage fund, may be considered.

3.5. A copy of the Resolution of the Council of Judges of the Republic on the results of the competition is attached to the personal files of civil servants - winners of the competition.

3.6. The awarding of the winners is carried out by the chairman of the Council of Judges in a solemn atmosphere.

Appendix No. 1

to the Regulations on the Competition

for the title “Best in Profession”

The competition work includes the disclosure of the topic “Knowledge of one’s profession, the goals and objectives of the state civil service and the role of a court employee in the implementation of the concepts of judicial reform.” You should reflect the main directions of your work, their features and emerging difficulties and proposals for eliminating them, a vision of the prospects of your profession (specialization).

The number of sheets in the competition work should not exceed 5.

Draft documents are attached to the work. An approximate list of draft documents is indicated below for each of the nominations and is required for preparation. Draft documents should be drawn up based on the competitor’s specialization.

The competition work and draft documents must be drawn up on A 4 paper, font 14. The list of draft documents is approximate and can be increased at the discretion of the competitor. In terms of volume, draft documents should fit on no more than 10 sheets. The volume will not affect the commission’s assessment of professional qualities.

If additional duties were assigned that fall under another nomination (profession) or the duties do not include the preparation of any documents, this should be reflected in the competitive work and a copy of the job duties (Regulations) should be attached.

List of draft documents:

1. assistant judge (assistant to the chairman of the court, consultant) - draft sentences and decisions, decrees and rulings on cases and materials (Code of Criminal Procedure of the Russian Federation, Code of Civil Procedure of the Russian Federation, Code of Administrative Offenses of the Russian Federation, Arbitration Procedure Code of the Russian Federation), work with citizens, registration of reception of citizens;

2. head of the department (chief specialist, leading specialist, court secretary) - samples of work orders, work books, contracts with general workers, time sheets, completed payment documents;

3. court secretary - minutes of court hearings in criminal, civil cases and materials;

It is also possible to provide the results of real work - reports, certificates of work, compiled summaries of judicial practice, business letters, responses to citizens' requests, results of work in reception rooms with citizens and other documents not included in the list.

If the nominee has previously participated in other competitions, then the results of work and projects that have not previously participated in competitions must be presented.
