An appeal by the General Director of PJSC IDGC of the North-West, Alexander Letyagin, who challenged the election of a preventive measure against him in the form of detention.

On May 15, the Syktyvkar City Court considered that Alexander Letyagin, accused of two counts of commercial bribery, could escape, continue to engage in criminal activities, or put pressure on witnesses. In the ruling, the court indicated that Letyagin was accused of committing a particularly serious corruption crime that poses an increased danger to society. According to the court, choosing a more lenient preventive measure against Letyagin, including house arrest or bail, at this stage of criminal proceedings is inappropriate.

Lawyer Konstantin Tskvitaria, defending Letyagin, pointed out in his appeal that the most severe preventive measure against Letyagin was applied without sufficient grounds. The arrest order was based, according to the defense attorney, on the unfounded assumptions of the investigation. Letyagin appeared on a summons to the investigator, and then arrived from St. Petersburg to the Syktyvkar court, although earlier searches had been carried out at his work and place of residence.

Today, at the request of the lawyer, the court added to the case materials orders that on March 28 and 29, 2018, Letyagin was on a business trip to Vologda.

My client has been charged that on March 29, 2018, he allegedly, while in St. Petersburg in the building of PJSC IDGC of the North-West, received from Shiryaev (Deputy General Director for Economics of PJSC IDGC of the North-West Pavel Shiryaev - BNK) some money. We assert that during the specified period Letyagin was on a business trip. The documents we have presented refute the suspicions of the investigation. The court of first instance refers to the contradictory testimony of Draidt (Deputy General Director of PJSC IDGC of the North-West - Director of the Komienergo branch Valery Draidt - BNK), who was detained red-handed. Drydt admitted that he received two million rubles and spent it on purchasing an apartment for his son.

The lawyer believes that under these circumstances, Drydt had reasons to slander Letyagin.
He referred to the practice of the European Court of Human Rights and to several decisions of the Constitutional Court of the Russian Federation, according to which the arrests of the accused were declared illegal.

Letyagin stated in court that the law does not provide for the election of a preventive measure on such grounds as expediency.

In his opinion, the court did not properly study the presented materials.

The court considered the vague and inconsistent testimony of Shiryaev and Drydt as eyewitness testimony. This argument seems doubtful, since Dreidt was caught red-handed and does not deny that he received money from Rubtsov through Sesyuk (deputy director of the Komienergo branch Evgeny Sesyuk - BNK) on his own initiative. The charge for the second crime is completely incomprehensible to me. No one explained to me what actions I committed, which, according to the investigation, constitute a crime,” the accused noted.

Let us recall that Komi investigators are investigating a criminal case against the General Director of PJSC IDGC of the North-West Alexander Letyagin, his Deputy for Economics and Finance Pavel Shiryaev, the Deputy General Director of PJSC IDGC of the North-West - Director of the Komienergo branch Valery Draidt and his Deputy Evgeniy Sesyuk, General Director of Mechanized Column No. 24 LLC, Commercial Director of TyumenSvyaz LLC.

They are suspected of commercial bribery committed by a group of persons by prior conspiracy and on an especially large scale (Part 4 of Article 204, Part 8 of Article 204 of the Criminal Code of the Russian Federation).

According to the investigation, the defendants, acting as a group of persons by prior conspiracy, received from representatives of commercial organizations as commercial bribery funds totaling more than five million rubles for assistance, unimpeded acceptance and payment for work under contract agreements with organizations and PJSC IDGC of North -West".

In the capital of the Komi Republic, a group of high-ranking power engineers led by the General Director of PJSC IDGC of the North-West, Alexander Letyagin, was arrested.

Both Letyagin and his subordinates are charged with Part 8 of Art. 204 of the Criminal Code - “commercial bribery committed by a group of persons on an especially large scale.” Despite the wording of the article, it seems that Letyagin himself was bribed first of all. According to Kommersant, he was arrested after interrogation in the case of kickbacks that power engineers in Komi received from local contracting companies for receiving contracts and paying for them. Letyagin has held the post of General Director of IDGC since July 2014, and before that he was General Director of Vyborg Electric Networks (VES), a branch of PJSC Lenenergo.

The current criminal case is not the first in Letyagin’s career. The previous ones were based on Leningrad stories. In June 2016, the office of IDGC in St. Petersburg and the 300-meter mansion of the head of IDGC in Lisy Nos were searched as part of two cases of fraud (Part 4 of Article 159 of the Criminal Code). As the head of the wind farm, in 2013, Alexander Letyagin concluded two contracts with the contractor - Vendelin LLC - which was supposed to connect facilities in the Priozersky district of the Leningrad region to the power grid. The work was not completed, but was paid for. For the non-existent 250 meters of electrical networks on Tsvetkova - Matrosova Street in Priozersk, as well as 500 meters plus a virtual transformer in the Larionovsky rural settlement, Letyagin counted out 5.5 million rubles to Wendelina. However, the investigation stopped for unknown reasons and none of the defendants was punished.

It is noteworthy that in the same 2013, Letyagin concluded another extremely dubious contract with the same “Wendelin” in the Vyborg region, but the St. Petersburg security forces did not investigate this fact. Who knows - perhaps this case would have had a better chance of surviving to trial.

This story was discussed in detail in “New” last year. PJSC Lenenergo held a competition for the development of funds from a targeted investment program to carry out work on connecting to the networks of the Krutoy Bereg cottage village. The contract value is almost 17 million rubles, the winner is Wendelin LLC. And everything would be fine, but at the time of the conclusion of the contract, Krutoy Bereg had long been connected to the Lenenergo power grid, and with all the official papers - an act of technical connection and an agreement from the St. Petersburg sales company. But physically this connection was made through a private power line, built at the expense of a neighboring dacha cooperative.

On the fact of illegal connection, a separate criminal case was even opened at the Main Investigation Department of the Ministry of Internal Affairs. However, according to the contract signed by Letyagin and Wendelin LLC, all facilities were built from scratch and on a turnkey basis using funds from the investment program. In order to legalize the certificates of completed work, VES and Lenenergo had to declare the private tap-off power line their property. However, for some reason, the owners of the power line did not want to give it up of their own free will (although, as the press service of Lenenergo told our publication, many power line owners seek to transfer them to the company’s balance sheet), and from that moment a long, grueling conflict began. Exhausting, of course, mainly for summer residents. According to the victims, in order to force them to hand over the power lines, the power engineers resorted to blackmail - they turned off their electricity.

Despite the fact that the Federal Antimonopoly Service and the Arbitration Court of the Northwestern Federal District recognized the rights of the owners of the power line, the VES did not calm down and tried, together with the Vyborg prosecutor’s office, to take possession of the property, recognizing it as ownerless. Apparently, the price of the issue was high.

According to the victims, Wendelin not only embezzled money under the contract, but did it with the knowledge of Lenenergo and VES.

After Alexander Letyagin transferred from Vyborg Electric Networks to IDGC of the North-West, the case of the alleged electrification of the village of Krutoy Bereg was continued by his successor S.V. Aminyakov. He signed a new agreement on its “connection”, now worth 18 million, with EnergoProjectEngineering CJSC (associated with the structure of Vadim Serdyukov, the son of the ex-governor of the Leningrad region). He also did not return the confiscated power line to its owners, although he was fined 16 thousand rubles for refusing to restore power supply. This year, the theft of power lines was finally completed. The new director of the wind farm, D.S. Chekhomov, formalized it as a “acceptance of a gift” to his company, although the owners did not think of giving anything.

It is logical to assume that similar schemes (payment for non-existent energy connection work in exchange for kickbacks) were implemented by Letyagin in Komi. Perhaps the victims there were more serious than the Leningrad summer residents, which led to the arrests of top managers. Let us add that a year ago the Lenenergo press service did not comment on the issue of fictitious connection contracts, but in its response focused only on the conflict with summer residents.

General Director of JSC IDGC of the North-West (a subsidiary of JSC Rosseti) Sergei Titov signed an order appointing Alexander Letyagin as acting first deputy general director.

Andrey Gorokhov, currently holding the position of Deputy General Director for Technical Issues - Chief Engineer of IDGC of the North-West JSC, is entrusted with the responsibilities of First Deputy General Director for Production Activities.

Alexander Letyagin and Andrey Gorokhov began work on February 3, 2014 and will remain in acting status until their candidacies are approved by the energy company’s Board of Directors.

The criminal case was born on April 13, when two top managers of the Komienergo branch were detained. And on May 3, the deputy head of IDGC of the North-West was arrested Pavel Shiryaev. They are all charged with commercial bribery. However, the “energy TOPs” will no longer have to use “commercial bribery” in order to avoid real punishment. According to our source in law enforcement agencies, this cannot be done without it, despite the fact that the most powerful lobbying structures are still in favor of Letyagin. That is why we will be closely monitoring the situation.

However, the connection with the management of IDGC North-West and their dark affairs in the Arkhangelsk region was established by investigative journalists a long time ago.

As compromising publications wrote then, a year ago Andrey Palkin and his son Mikhail managed to put behind bars the journalist, editor-in-chief of the Kompromat 29 portal Alexander Sukhanov. The whole point is that the journalists of the Kompromat29 portal, which belonged to Alexander Sukhanov, uncovered a grandiose scam by the monopolist represented by IDGC North-West and the government structures of the Arkhangelsk region, associated with artificially inflated electricity tariffs. As a result, overpayments by consumers – legal entities and individuals – amount to more than 1 billion rubles annually. In addition, power engineers openly cheat with electricity accounting, charging double payments from some consumers. There is a decision of the Arbitration Court on this matter:

“The Arbitration Court of the Arkhangelsk Region completed the consideration of case NА05-5591/2013 and found that the Arkhenergo branch of IDGC of the North-West received unjust enrichment that arose as a result of double accounting of consumed electrical energy in the amount of 2.3 million rubles,” the portal reports ArchFreedom.

However, it turned out that it was easier to get rid of journalists in any possible way. When discussing this issue, our colleagues from Arkhangelsk had no doubt that if Sukhanov had not been imprisoned, he would have been physically liquidated - the price of the incriminating evidence found on Andrey Palkin, governor Igor Orlov and large companies. Its publication could initiate a huge scandal throughout the country, in which local FSB officers will not help Palkin and Orlov.

Alexander Sukhanov is not the only journalist who has suffered from the actions of a company that colluded with Governor Orlov. In 2014, a famous journalist was brutally beaten by unknown assailants. Andrey Zakharov, who published the newspaper “Pillory Pillar,” where he also talked about the facts of the redistribution of the energy market in the Arkhangelsk region under the auspices of Governor Orlov. At that time, the Arkhangelsk branch of PJSC IDGC North-West was headed by his fellow countryman, a native of Kaliningrad, Alexander Kotenko. Then, according to the tax return, the official income of the energy top manager was 13 million rubles.

“Yes, you can kill for that kind of money,” the emotional reader will say, and he will be right.

It was literally a miracle that Andrei Zakharov survived then.

ALEXANDER LETYAGIN'S FAVORITE "BUSINESS"

Here we are talking about a protracted conflict between the authorities, a branch of PJSC IDGC "Arkhenergo" and the "marketer" intermediary between the electricity supplier and consumers - the "supplier of last resort" (professional bureaucratic term) Arkhenergosbyt. Budgetary organizations of the Arkhangelsk region have incurred debts to Arkhenergosbyt, but are not going to pay. “Marketers” pay more than three billion to suppliers at their own expense. In this situation, Governor Orlov twice asked the Government of the Russian Federation to deprive Arkhenergosbyt of the status of a “guaranteeing organization” and transfer these powers to Arkhenergo, a branch of IDGC North-West. That is, simply “throw money” at the lender and take control of financial flows into your own hands. The conflict is still smoldering and thanks to Governor Orlov’s participation in it, there is no end in sight.

Alexander Vyacheslavovich Letyagin, who holds the post of General Director of the public joint stock company IDGC of the North-West, was born in 1976 in Ivanovo.

In 1998, he received the specialty “electrical engineer”, graduating with honors from Ivanovo State Energy University (Ivanovo State Energy University), the following year, already working at his alma mater as a laboratory assistant, he began postgraduate studies. Letyagin’s career began a year after receiving his diploma, at the Belgorod Thermal Power Plant. Having started his career as an electrician responsible for repairing relay protection devices, by 2002 Alexander Vyacheslavovich became the head of one of the departments of the electrical workshop, the electrical laboratory.

In 2002, Alexander Letyagin received the position of head of the laboratory of the relay protection and automation service of Belgorodenergo, and since then his career has taken off. From 2003 to 2006, he held exclusively management positions: he was deputy director of the Distribution Zone, deputy chief engineer, head of the technical policy and development department, as well as deputy technical director of Belgorodenergo.

From 2006 to 2012, Alexander Vyacheslavovich worked at Orelenergo, a branch of IDGC of Center. In this organization, Letyagin worked as chief engineer, technical director, deputy general director for technical issues, and then branch director.

In 2012, Alexander Vyacheslavovich was an adviser to the general director of Vyborg Electric Grids, one of the branches of JSC Lenenergo. His work in this position subsequently raised questions from the economic police: according to the investigation, Letyagin’s company entered into a contract with Wendelin LLC to carry out construction and installation work in the Priozersky district for technical connection to power grids, paying five and a half million rubles for them. However, the work was not completed. In connection with the investigation, the police conducted searches in Letyagin’s office and even in his mansion in Lisy Nos. The former head of Lenenergo, Andrei Sorochinsky, to whom Letyagin was an adviser, was completely accused of abuse of power, which led to damage in the amount of more than 50 billion rubles.

Nevertheless, in February 2014, Letyagin was appointed acting. O. first deputy general director of IDGC of the North-West, and in April of the same year - acting general director of the enterprise. In July 2014, Alexander Vyacheslavovich took the post of General Director of IDGC of the North-West, where he works to this day. Since 2015, Alexander Letyagin joined the company’s Board of Directors.

Alexander Letyagin’s activities at IDGC were also not without a serious scandal: as soon as he started work, he ordered the opening of an account in the Tavrichesky bank, where more than three billion rubles were subsequently transferred. The logic of the actions of the management of IDGC and Lenenergo, which also opened a deposit in this credit organization, was quite simple: having collected loans from Sberbank, Promsvyazbank, VTB and Rossiya Bank at 8-9.4%, the organizations placed this money in Tavrichesky "at 9.7-11.5 per annum. On January 19, 2015, Tavrichesky ceased its activities, which caused serious problems for Lenenergo: by hiding the fact of placing funds in Tavrichesky in its reporting, Andrei Sorochinsky lost his position, and Letyagin got off with a “serious reprimand.” Economic security officers of Rosseti conducted their own investigation into the legality of the actions of their subsidiaries, but the results remained unknown and are of a “for official use” nature.
