It's no secret that many foreign citizens come to Russia from neighboring countries to earn money. However, not everyone can find a permanent and high income, which is why many foreigners wonder whether it is possible to register with the employment center without Russian citizenship and a residence permit. Legal regulation of the status of foreign citizens of the Russian Federation

Based on Federal Law No. 115 of July 25, 2002 “On the legal status of foreign citizens in the Russian Federation,” citizens of foreign states and stateless persons can stay on the territory of the Russian Federation if they have the necessary documents confirming the right to permanent or temporary residence.

Can a foreign citizen register with the employment center?

The procedure for registering unemployed citizens with the Employment Service is regulated by Law No. 1032-1 “On Employment”. Based on the document, citizens who are recognized as able-bodied, but are not employed at the time of contacting the Employment Service, can register as unemployed, which is confirmed by:

  • the absence of a valid labor relationship with the employer, based on entries in the work book;
  • lack of valid registration of a citizen in the Unified State Register as a self-employed person.

Disabled people of groups 2 and 3 can also register with the employment center (EC), provided that they are recognized as able to work on the basis of an ITU act.

Based on clause 2 of Art. 6 of the Law “On Employment”, not only citizens of the Russian Federation, but also foreign citizens, as well as stateless persons temporarily or permanently residing in the territory of the Russian Federation have the right to register with the Employment Center.

How can a foreigner register with the CZN?

Registration of unemployed foreigners and stateless persons permanently or temporarily residing in the Russian Federation with the Employment Center is carried out by applying such citizens to the territorial body of the Employment Service at the place of residence with the following documents:

  • passport of a foreign citizen;
  • RVP or residence permit;
  • employment history;
  • SNILS confirming registration in the compulsory pension insurance system (if available);
  • certificate of secondary education;
  • diploma of secondary specialized/technical/higher education.

A foreign citizen submits to the CZN diplomas, certificates, work books issued to him in the territory of his native state. Along with the documents, the unemployed person provides the Employment Service with translations of documents, the originals of which are in a foreign language.

On the day of application to the Center for Labor Protection, a foreign citizen is registered as unemployed. During the period of registration, an unemployed foreigner can use the services of the Job Search and Training Service.

The Employment Center selects vacancies in accordance with the education, experience, and professional qualifications of a foreign citizen, after which it issues a written referral to the unemployed for an interview. If negotiations with a potential employer are successful, the citizen is registered for work (concludes an employment contract), after which he is automatically deregistered from the Central Employment Employment Center.

In Moscow, as before, professional managers are in demand, since many of those who occupy leadership positions, unfortunately, as many HRDs admit, do not have sufficient management competencies.

Programmers, IT specialists, engineers, designers, pharmacists are also in demand; as in any crisis - sales managers, sellers.

Lawyers, psychologists, and economists are not in demand. There are many more candidates for these positions than there are employer vacancies

Financial issue

Transparency and honesty of payrolls have never been the strong point of the post-Soviet countries. Most Moscow employers do not stand out much from the general background, preferring to pay employees salaries in envelopes. An exception to the rule are international companies that are accustomed to paying all taxes to the treasury.

Banks: managers at various levels - 70,000–400,000 rubles, middle management - 30,000–100,000 rubles;

IT sector: managers - 70,000–300,000 rubles;

Working in Moscow for foreign citizens is not such a big problem. Both builders and salespeople, as well as top managers with experience in managing large projects, will be able to find work here. The main difficulty is due to the fact that not every company is ready to officially employ a foreigner. This is due to migration legislation and huge fines, which can reach 800 thousand rubles even for the slightest mistake.
However, employers hire foreigners, but often in violation of the Labor Code.

Foreigners in any country are a socially unprotected category. The most common violation is extended working hours. In certain areas of employment, there are precedents where foreign workers are paid less. Salaries are often paid with a large number of violations: with delays, step-by-step payments, when remuneration for January is received in March, and according to “gray” schemes.

And yet, a foreigner in Russia can get a job with normal conditions and compliance with the Labor Code.

Look for work from trusted sources

A foreigner can protect his rights only by signing an employment contract with the employer. To search for companies that work in compliance with the Labor Code, you need to post your resume on trusted recruiting portals. Job sites check employers, so the chance of getting a job with normal conditions increases.

You can look for work through the consulate of the applicant’s country; It makes sense to contact national companies that have representative offices in Russia. These are the two fastest and most relaxing options for finding a job.

Prepare your documents
To apply for a work permit, you first need to receive an official offer from the company.

To obtain a permit, a foreign citizen submits an application for a work permit in person through the FMS (Federal Migration Service of the Russian Federation), or through an organization that provides employment to foreign citizens in the Russian Federation, or through a person acting in accordance with the civil legislation of the Russian Federation as a representative of this foreign citizen.

Along with the application, the foreign citizen submits:

  • a document identifying the foreign citizen and recognized by the Russian Federation in this capacity (passport);
  • migration card. In case of failure to submit the specified migration card, the federal executive body in the field of migration or its territorial body checks, on the basis of information available in these bodies, the data on the foreign citizen contained in the specified migration card;
  • a certificate of full-time training of this foreign citizen in a professional educational organization or educational organization of higher education according to the main professional educational program that has state accreditation, issued by the specified educational organizations;
  • an employment contract or a civil contract for the performance of work (provision of services), concluded and formalized in accordance with the legislation of the Russian Federation;
  • a receipt confirming payment of the state fee for issuing a work permit to this foreign citizen. In case of failure to provide the specified receipt, the federal executive body in the field of migration or its territorial body verifies the fact of payment of the state duty for issuing a work permit to this foreign citizen using information on the payment of the state duty contained in the State Information System on State and Municipal Payments;
  • documents confirming that the foreign citizen does not have drug addiction and infectious diseases that pose a danger to others, as provided for in the list approved by the federal executive body authorized by the Government of the Russian Federation, as well as a certificate confirming that the foreign citizen does not have a disease caused by the human immunodeficiency virus (HIV) -infections).

If you are an international student

In Russia, the practice of employing foreign students is not very common - not every employer is ready to spend time on the procedure for registering such employees.

If an expat student nevertheless begins to look for a job, it is worth contacting recruitment agencies - it is easier for them to find employers who, in principle, are ready to take on the trouble of registering an expat “in a white way.” Alternatively, you can look for advertisements in English-language magazines such as The Moscow Times and expat groups on Facebook.

Most often, students work as foreign language tutors. This is probably the most common practice, since it allows you not only to get an official job in a company, but also to work as a freelancer.

Career centers at universities can help you find a job; as a rule, they offer direct access to employers or work closely with recruiting portals.

Foreign students of universities and colleges should know

Subparagraphs 6 and 7 of paragraph 4 of Article 13 of the Federal Law of July 25, 2002 N 115-FZ “On the Legal Status of Foreign Citizens in the Russian Federation” provide for the opportunity to work without obtaining a work permit for foreign citizens:

Those studying in the Russian Federation in vocational educational institutions and performing work (providing services) during the holidays;

Those studying in the Russian Federation in educational institutions of vocational education and working in their free time as educational support staff in the educational institutions in which they study.

If a student enters into an employment contract with a company, one copy is given to the student so that he can present it to the Federal Migration Service of Russia (its territorial body) to obtain a work permit.
