GENERAL PROVISIONS

    1. 2.3. Conducts:

2.4. Participates:

2.9. Ensures correct and timely execution of primary documents for recording working hours, execution of acts - protocols for unaccounted electricity consumption.
2.10. Maintains documentation on the organization of work of controllers and reports on the work performed by them.
2.11. Draws up protocols on administrative violations and violations of the requirements of the “Rules for the Use of Electricity for the Population.”
2.12. Gives proposals for improving the work of controllers in servicing residential electricity consumers and introduces regulatory tasks and measures to reduce the commercial component of electricity losses.
2.13. Performs and monitors compliance with the requirements of regulations on labor protection, the use of collective and individual protective equipment, compliance with standards, methods and techniques for safe work.
2.14. Implements measures to improve working conditions provided for by labor legislation, collective agreement and internal labor regulations.

III. RIGHTS

VI. QUALIFICATION REQUIREMENTS

  • Check the compliance of projects of new and reconstructed electrical, fuel and heat-using installations with the current safety regulations for the operation of these installations and the requirements for rational use of energy and give instructions to the relevant officials to eliminate identified violations.
    In accordance with this requirement, Gosenergonadzor must coordinate all projects (electrical, thermal and fuel parts), including those on issues of rational use of energy.
  • Freely enter the premises of electrical, fuel and heat-using installations at any time of the day upon presentation of an official ID and an order to conduct an inspection (Article 7 of the Federal Law of 08.08.2001 No. 134-FZ). In this case, the order to conduct an inspection must contain:
    - number, date of the order to conduct the inspection;
    - name of the state energy supervision body;
    - last name, first name, patronymic and position of the person(s) authorized to carry out the control measure;
    - name of the legal entity (individual entrepreneur) in respect of which the control measure is being carried out;
    - goals, objectives and type of control measures;
    - legal grounds for carrying out control activities;
  • - start and end date of the control activity.
    It should be noted that when conducting licensing control, as well as in the case of control of objects recognized as dangerous in accordance with the legislation of the Russian Federation, the presentation of an order to conduct an inspection is not required. It is also not required if control measures are carried out in connection with the application of the enterprise itself.
    The rules for the use of electrical and thermal energy previously clearly stated that preventing an energy supervision official from accessing consumer electrical installations or electricity metering devices is an unconditional basis for stopping the supply of electrical energy.
The inspector is obliged to keep trade secrets

To carry out the functions assigned to the Gosenergonadzor bodies, they can request from organizations the necessary information and materials on issues related to the field of state energy supervision. At the same time, the reference to the fact that a particular document constitutes a trade secret is completely unfounded. The inspector has the right to demand any document that he needs to perform his functions. Naturally, he is responsible for disclosing the company's trade secrets - just like, for example, a tax inspector or tax police officer. The State Institution “Petersburggosenergonadzor” has developed and approved the Regulations on Official Information, which regulates the procedure for handling information that became known to the inspector of Gosenergonadzor in the process of energy supervision, including information that constitutes a trade secret.
If, as a result of the disclosure of a trade secret by an inspector of Gosenergonadzor, the organization is harmed, the organization has the right to file a claim in arbitration court for compensation for the damage caused.
Officials exercising state energy supervision in the Russian Federation are responsible for fulfilling the duties assigned to them. Actions of officials exercising state energy supervision in the Russian Federation may be appealed in accordance with the established procedure. However, filing a complaint does not suspend the implementation of the appealed decision (clause 11 of the Decree of the Government of the Russian Federation of August 12, 1998 No. 938).

The energy supervision service is managed by the Government of the Russian Federation.

In the regions, supervisory functions are performed by territorial bodies at the interregional level. As a rule, these bodies supervise objects and enterprises of several industries.

The competence of Energonadzor includes:

control (within its competence) over compliance with safety requirements in the electric power industry, including requirements for the safety of operation of thermal and electrical networks and installations, with the exception of household ones,
control over construction, reconstruction and major repairs of facilities.

That is, the main task of Energonadzor is to prevent accidents, injuries, as well as reduce the negative impact on the environment and human health as a result of the activities of facilities, and ensure safety and prevent man-made accidents.

In its activities, Energonadzor may be guided by: decrees and orders of the President of the Russian Federation, the Constitution of the Russian Federation, acts of Rostechnadzor and the Ministry of Natural Resources, federal laws and acts, as well as international treaties of the Russian Federation.


Scheduled inspections of Energonadzor

Scheduled inspections can be carried out by Energonadzor no more than once every three years. The basis for such inspections is the annual plan of Energonadzor. Information about scheduled inspections can be found on the websites of the Prosecutor General's Office of the Russian Federation (www.genproc.gov.ru) and territorial bodies of Rostechnadzor. The basis for including an enterprise on the list for a scheduled inspection may be:

the expiration of 3 years from the date of the last scheduled inspection,
expiration of 3 years from the date of state registration of the enterprise.

The subject of the inspection is the safety of the electrical installations and networks used.

If the enterprise is a contractor (customer) or developer, then Energonadzor can also conduct an inspection when putting the facility into operation or when accidents occur.

It is also worth considering that the inspection can be comprehensive, that is, carried out not only by inspectors of the territorial body of Energonadzor, but also by employees of the central office of Rostechnadzor with any number of inspectors.

Carrying out a scheduled inspection does not mean the arrival of inspectors to the enterprise. Before the inspection, Rostechnadzor specialists check the enterprise’s annual report on the organization of production control and its implementation. The need for inspectors to visit arises when violations are detected (for example, the absence or incorrect preparation of a report, the expiration of a license, etc.).

Unscheduled inspections of Energonadzor

To conduct an unscheduled inspection of an enterprise by Energonadzor, the basis may be statements and appeals from individuals, individual enterprises, legal entities, local governments and state authorities, as well as information in the media about the following facts:

causing harm to the health and lives of citizens, plants, animals, the environment, as well as objects of cultural heritage of the peoples of the Russian Federation and the occurrence of emergency situations of man-made and natural nature,
the emergence of a threat of harm to the health and life of citizens and animals, the environment, plants, cultural and historical monuments of the peoples of the Russian Federation, state security, as well as the threat of man-made and natural emergencies.

Violation and punishment from Energonadzor

If violations are identified during the inspection, Energonadzor inspectors issue an order to the budgetary organization to eliminate them, the implementation of which they must subsequently monitor.

Example. In relation to the State Educational Institution “Secondary School No. 202” in St. Petersburg, an inspection was completed on July 4, 2013, which was carried out to monitor compliance with mandatory safety requirements during the technical operation of power plants and networks of enterprises and requirements in the field of electric power industry.
If, during an inspection, Energonadzor inspectors identify violations, they are obliged to issue an order to the head of the budget organization to eliminate them, indicating a time frame. Subsequently, inspectors are required to check whether the requirements of the order have been fulfilled and whether the identified violations have been eliminated.

During the inspection, 37 violations were identified:

non-compliance with mandatory forms of work with personnel,
lack of organization of safe work in electrical installations,
non-compliance with the requirements for the composition and maintenance of operational and technical documentation.

Based on the results of the inspection, the official was brought to administrative liability in the form of a fine.

If, during an inspection, it is established that the organization’s activities pose a direct threat to harm to the life and health of citizens, plants, animals, state security, the occurrence of man-made and natural emergencies, or such harm has been caused, representatives of Rostechnadzor are obliged to take measures immediately, up to a temporary ban activities of the organization. In addition, inspectors can remove products from circulation that pose a threat and bring to the attention of citizens information about the threat of harm and methods that will help prevent it.

As a rule, if violations are detected during an inspection, fines in the amount of 2-3 thousand rubles are imposed for officials and 20-30 thousand rubles for legal entities. Suspension of activities is used in case of violations that pose a threat to the life and health of people or the threat of a man-made disaster.

Rights of the person inspected by Energonadzor

The procedure for conducting inspections is regulated by Federal Law No. 294 of December 26, 2008. According to it, the head of a budget organization has the right:

personally attend the inspection,
receive from inspectors information that is provided for by the Federal Law and relates to the subject of the inspection,
provide explanations to questions regarding the subject of inspection,
familiarize yourself with the results of the inspection and indicate in the relevant act your agreement or disagreement with the results or actions of the inspectors,
appeal against actions or inaction of inspectors that resulted in a violation of the organization’s rights both administratively and judicially (in accordance with the legislation of the Russian Federation).

If the inspection, in the opinion of the head of the organization, is unauthorized or is carried out in violation of rights, it is worth remembering Art. 212 of the Labor Code of the Russian Federation, according to which the employer is obliged to provide the federal executive authorities that carry out the functions of control and supervision in the established field of activity, “information and documents necessary for them to exercise their powers,” as well as ensure “unimpeded access ... to officials federal executive authorities authorized to conduct state supervision and control for the purpose of conducting inspections of labor conditions and safety and investigating industrial accidents and occupational diseases." That is, the head of the organization must in any case ensure the possibility of carrying out an inspection, but has the right to protest it later.

The inspection period is no more than 20 working days. But due to the need to conduct lengthy or complex examinations, tests and investigations, an unscheduled on-site inspection can be extended, but no more than 20 days, and for small and micro enterprises - no more than 15 hours.
